Terms of Service
Last updated: September 2026
1. Acceptance of Terms
By accessing or using KiiTOS ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
KiiTOS is an AI-powered video generation platform that enables users to create promotional, meaningful, and educational video content using digital avatars, AI voice synthesis, and automated video production tools. The Service is provided on a prepaid, finished-video pricing model, denominated in US dollars.
3. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
4. Account Registration
You must provide accurate, complete, and current information during registration. You are responsible for safeguarding your password and for all activities that occur under your account.
5. Acceptable Use
You agree not to use the Service to create, generate, distribute, or facilitate any of the following:
- Deepfake content intended to deceive, defraud, harass, blackmail, or harm any individual or organisation
- Content that impersonates, defames, harasses, or exploits another person
- Content involving minors in inappropriate contexts
- Content that violates intellectual property rights of third parties
- Content that promotes violence, terrorism, or criminal activity
- Content intended to manipulate elections or public discourse
6. AI-Generated Content Disclosure
All video, audio, and image output produced through the Service is synthetic media generated by artificial intelligence. You acknowledge and agree that:
- You are solely responsible for clearly labelling any content you publish as AI-generated, in accordance with applicable laws including Article 50 of the EU AI Act
- Where content depicts a real, identifiable person, you must include a visible disclosure that the content is synthetic
- We reserve the right to embed visible or invisible watermarks and provenance metadata (such as C2PA) in all generated content
7. Consent Requirements
You represent and warrant that you possess explicit consent from each individual whose face, voice, or likeness you upload or reference in the Service, authorizing both AI processing and the resulting video output. Failure to hold valid consent constitutes a material breach and may expose you to civil and criminal liability.
8. Intellectual Property
Subject to your compliance with these Terms, you retain ownership of all content you create using the Service. We do not claim ownership over your generated videos. However, you grant us a limited license to store, process, and display your content as necessary to provide the Service.
9. Pricing and Payment
The Service uses a wallet-based prepaid model in US dollars. You top up funds (from $10) and each finished video is charged at its listed price (for example, $4.99 for a 15-second promo). Prices are as stated on the Pricing page and may change with 30 days notice. All payments are processed through Stripe.
9a. Wallet Funds — Closed Loop
Wallet funds (including top-ups, bonuses, course enrolment rewards, and creator revenue share) may only be used on the platform to create videos or enrol in courses. Wallet funds cannot be withdrawn, transferred to other users, exchanged, or redeemed for cash. Gifting and tipping are not supported. Refunds apply only to unused top-up funds within 7 days of purchase, via the original payment method.
9b. Membership & Revenue Share
Membership is optional and billed monthly: Member at $5/month (5% revenue share) and VIP at $25/month (25% revenue share). Non-members may create videos and enrol in courses but do not receive revenue share on their published courses. Revenue share is credited to your wallet as platform funds subject to Section 9a.
9c. Edlab Plan — Schools & NGOs
The Edlab Plan offers full VIP benefits (including 25% revenue share) at a reduced monthly fee of $10 for registered schools and recognised non-governmental organisations and charities. Eligibility requires an application supported by valid organisation registration documents (such as a school registration certificate or charity registration). We reserve the right to verify documents, request additional proof of eligibility, and revoke the Edlab Plan if eligibility ceases or documents are found to be invalid. All wallet-fund rules in Section 9a apply to Edlab Plan accounts.
10. Limitation of Liability
To the fullest extent permitted by law, KiiTOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless KiiTOS, its affiliates, and personnel from any costs, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your access at any time, with or without cause. Violations of Sections 5, 6, or 7 constitute grounds for immediate termination without refund.
13. Governing Law
KiiTOS is operated by a company incorporated in Hong Kong, operating on social enterprise principles. These Terms shall be governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
As part of our social mission, we offer preferential terms to accredited schools and registered charitable organisations — see our Copyright & IP Policy for details.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
